# Bylaw - financing Created by: Tomislav Mamić Summary BASIC PROVISIONS This regulation establishes criteria, standards, and procedures for financing programs and projects of public interest carried out by associations. The regulation applies to competent bodies of state administration, government offices, public institutions, local and regional self-government units, public trading companies, and other legal entities that finance association programs and projects. It also applies to non-financial support in rights, movable and immovable property. The regulation covers criteria, standards, and procedures for approving financial resources from public sources for various purposes. CRITERIA FOR FINANCING AND CONTRACTING PROGRAMS AND/OR PROJECTS The provider of financial resources ensures financial resources, organizational capacities, and human resources for the implementation of basic standards for financing, contracting, monitoring implementation, and evaluating the results of programs and projects. Basic standards include financial planning, financing implementation, monitoring and evaluation, and reporting. The provider of financial resources conducts public tenders, evaluates applications, signs contracts, and monitors the implementation of programs and projects. ### Law No. 26/2015 (March 9, 2015), Regulation on criteria, standards, and procedures for financing and contracting programs and projects of public interest carried out by associations GOVERNMENT OF THE REPUBLIC OF CROATIA 546 Based on Article 33, paragraph 2 of the Associations Act ("Official Gazette", No. 74/2014), the Government of the Republic of Croatia, at the session held on March 5, 2015, adopted REGULATION ON CRITERIA, STANDARDS, AND PROCEDURES FOR FINANCING AND CONTRACTING PROGRAMS AND PROJECTS OF PUBLIC INTEREST CARRIED OUT BY ASSOCIATIONS I. BASIC PROVISIONS ### Article 1 (1) This Regulation establishes criteria, standards, and procedures that competent bodies of state administration, government offices and bodies, and other public institutions, having funds from public sources, apply when financing and contracting programs and/or projects of public interest carried out by associations (hereinafter: programs and/or projects). (2) The criteria, standards, and procedures laid down in this Regulation are also applied, accordingly, by local and regional self-government units, trading companies owned by the Republic of Croatia, or one or more local and regional self-government units, and other legal entities established by the Republic of Croatia or one or more local and regional self-government units (hereinafter: public trading companies), as well as other legal entities that finance association programs and projects from public sources, donate or sponsor associations, unless otherwise regulated by special regulations. (3) Public sources include funds from the state budget, including earmarked funds from games of chance, funds from county, city, and municipal budgets, as well as funds from public funds and revenues of public trading companies and other public institutions, European Union funds, and foreign public sources. (4) Unless otherwise provided by special regulations, the provisions of this Regulation apply when financial resources from public sources are approved to associations for: - implementation of programs and projects that fulfill the goals and priorities defined in strategic and planning documents, - implementation of national, regional, and local programs of public needs determined by special laws, - exercising a specific public authority entrusted by special law, - providing social services based on special regulations, - co-financing the obligatory contribution of financing users for the implementation of programs and projects contracted from European Union funds and foreign public sources, - supporting the institutional and organizational development of the association, - employment programs or projects, - donations and sponsorships, and - other forms and purposes of allocating financial resources from public sources. (5) The provisions of this Regulation are also applied, accordingly, when non-financial support is approved to associations in rights, movable and immovable property. ### Article 2 (1) The criteria established by this Regulation refer to the prerequisites provided by the provider of financial resources from public sources in Articles 1, paragraphs 1 and 2 of this Regulation (hereinafter: provider of financial resources) and
